The Interpretation of Slavery before the International Criminal Court: Reconciling Legal Borders?

This article examines the interpretation of definition slavery/ enslavement by International Criminal Court (ICC) in Ongwen case (2021) and its application to facts at hand. examination is warranted because represents first which ICC was tasked with deciding whether crime had been committed. illustrates that has outward-looking, finding judgments other courts largely featured reasoning when interpreting slavery. The detailed study this further reveals that, either directly or indirectly, more specifically drew on judgment Tribunal for Former Yugoslavia (ICTY) Kunarac case. shows doing so, reconciled legal borders incorporating decision elements general international law, human rights humanitarian law instruments inform understanding slavery/enslavement. highlights contributed norm consolidation globally.
